In accepting and utilizing any electronic drawings in the file, or other data that may be generated from this file, the recipient accepts all responsibility of the fact that any interpolations and any variations contained on the electronic file, not shown by the signed, sealed and approved hard copy of the plans, are not errors or omissions and shall not be interpreted as such. Furthermore, it must be understood that the electronic file is to assist with the checking of site construction quantities and does not necessarily represent the final contract plan.
The recipient agrees to waive all claims against CEC resulting in any way from variations contained on the electronic plans deviating from the signed, sealed and approved hard copy of the plans. In addition, the recipient agrees to indemnify and hold CEC harmless from any damage, liability, or cost, including reasonable attorney’s fees and costs of defense, arising from any interpolation and/or variations which may be contained on the electronic file.
Furthermore, CEC makes no warranties, either expressed or implied, of the accuracy of the material contained on the electronic file.
Should questions arise with the use of this electronic file, advise CEC immediately and do not proceed with further use of the file until such use has been cleared.
